Changes and New Faces in 115th Congress

The new 115th Congress got underway in January and was promptly faced with the challenges of a new Administration.

The U.S. Senate began the process of confirming President Trump’s Cabinet, with U.S. Department of Transportation Secretary Elaine Chao among the first to be approved.  Once the Senate approves the President’s cabinet, it will move on to subcabinet and independent agency nominations, including a new Federal Railroad Administrator (FRA) and two new members of the Surface Transportation Board (STB or Board).

Both Houses are faced with an April 28 deadline to approve an appropriation measure or a third Continuing Resolution for the remainder of the current Fiscal Year (FY) 2017.

The Trump Administration might submit an outline of its FY 2018 Budget to the U.S. Congress in March but details might not be presented until May.  The new FY 2018 begins October 1.

 

U.S SENATE

Commerce, Science and Transportation Committee

In the current 115th Congress, the Commerce, Science & Transportation (Commerce) Committee is expected to continue its oversight of the implementation of the STB Reauthorization Act of 2015 (P.L. 114-110), the railroad industry’s continued implementation of positive train control technology, and the activities of the FRA.  The Committee will also be holding the eventual nomination hearings for the two new STB Members following their respective nominations by President Trump.

All but one of the seven Committee members who sought reelection in the November elections returned to Congress – Senator Kelly Ayotte (R-NH), who narrowly lost reelection bid.  Her replacement, Sen. Maggie Hassan (D-NH) was appointed to the Committee.

Sen. John Thune, R-SD, won reelection and is again serving as Committee Chairman, while Sen. Bill Nelson (D-FL) returns as the Committee’s ranking member.

Sen. Steve Daines (R-MT) left the Committee for a seat on the Senate Agriculture, Nutrition and Forestry Committee and the Homeland Security and Governmental Affairs Committee.  Sen. Claire McCaskill (D-MO) left the Committee for a seat on the Senate Finance Committee, while fellow Committee member Sen. Joe Manchin (D-WV) moved for a seat on the Senate Appropriations Committee.

New members of the Committee in addition to Sen. Hassan are Senators: Jim Inhofe (R-OK), Mike Lee (R-UT), Shelley Moore Capito (R-WV), Tammy Baldwin (D-WI), Tammy Duckworth (D-IL), and Catherine Cortez Masto (D-NV).

Sen. Baldwin is a long-time advocate for rail shippers.  In the 114th Congress, she sponsored The Rail Shipper Fairness Act of 2015 (S 853), that would have reduced costs and improved service problems faced by a broad coalition of Wisconsin (and national) rail shippers, including farmers, manufacturers and utilities. In addition to her rail shipper fairness bill, Senator Baldwin supported another STB reauthorization measure, the STB Reauthorization Act of 2015.  Her leadership efforts helped clarify the statutory and congressional intent of the bill’s Section 16 (Criteria).

Surface Transportation Subcommittee
U.S. Sen. Deb Fischer (R-NE.) returns as chairwoman of the Subcommittee on Surface Transportation and Merchant Marine Infrastructure, Safety and Security, while Sen. Cory Booker (D-NJ) is again serving as the Subcommittee’s ranking member.

Fischer has been a leader on transportation and infrastructure issues, dating to her time in the Nebraska Legislature.  She also chaired the subcommittee during the previous 114th Congress.

The Subcommittee’s jurisdiction includes the reliability and efficiency of the U.S. freight and passenger transportation network, as well as oversight of federal agencies involving transportation research, rail, pipelines, maritime shipping and ports, and commercial trucks and buses.

New members of the subcommittee include Senators:  Inhofe, Cory Gardner (R-CO), and Todd Young (R-IN)

Senate Appropriations Committee
The 115th Congress brings some new faces to the Senate Appropriations Committee following the defeat of Committee member Sen. Mark Kirk (R-IL) and the retirement of Sen. Barbara Mikulski (D-MD), the Committee’s ranking member.

The Appropriations Committee provides the annual appropriated funding for the FRA, STB, and rail safety programs.

Chairman Thad Cochran (R-MS) is continuing to chair the Committee. Sen. Patrick Leahy (D-VT) also won reelection and was named ranking member, giving up his slot as ranking member of the Senate Judiciary Committee.

Sen. Bill Cassidy (R-LA) left the Committee to join the Senate Finance Committee.

New members of the Committee include Senators: Lindsey Graham (R-SC); John Hoeven (R-ND), Chris Van Hollen (D-MD), and as noted earlier, Manchin.

Transportation Subcommittee
On the Transportation, Housing and Urban Development and Related Agencies Subcommittee, the new Chairman is Sen. Susan Collins (R-ME) for former Chairman, Sen. Richard Shelby (R-AL) had to relinquish this spot to chair the Senate Rules Committee.  Sen. Jack Reed (D-RI) replaces Patty Murray (D-WA) as ranking member.

Senate Judiciary Committee
Although the Senate Judiciary Committee has jurisdiction over transportation antitrust issues, other than those pertaining to railroads which remains with the Commerce Committee, the Judiciary Committee is of interest to FRCA and all freight rail shippers.

Sen. Chuck Grassley (R-IA) returns as chairman after winning reelection in the November elections. Sen. Diane Feinstein (D-CA) is the new ranking member after the previous Ranking Member, Sen. Leahy, chose the top Democratic spot on the Appropriations Committee (as discussed earlier).  Sen. Chuck Schumer (D-NY) stepped down from the Committee to serve as Senate Minority Leader.

Freight rail shipper supporters, Sen. Amy Klobuchar (D-MN) and Al Franken (D-MN), continue serving on the Committee.

Sen. David Vitter (R-LA) retired in December 2016. Sen. Jeff Sessions (R-AL) resigned from Congress, leaving the Committee, after being confirmed as U.S. Attorney General. Sen David Purdue, R-GA) left the Committee for a position on the Armed Services Committee.

New to the committee this year are Senators Ben Sasse (R-NE), Mike Crapo (R-ID), John Neely Kennedy (R-LA), and Mazie Hirono (D-HI).

Senate Agriculture, Nutrition and Forestry Committee
Given the unique shipper concerns facing the grain and farming industries, FRCA monitors the actions of the Senate Agriculture, Nutrition and Forestry Committee.

All three members of the Senate Agriculture Committee – Sen. John Boozman (R-AR), Sen. Chuck Grassley (R-IA), and Sen. John Hoeven (R-ND) – that ran for reelection in November 2016 returned to Congress. 

Sen. Pat Roberts (R-KS) returns as chairman for this new 115th Congress, as does Ranking Member Sen. Debbie Stabenow (D-MI).

Sen. Steve Daines (R-MT) and Sen. Chris Van Hollen, D-MD joined the Committee.

 

U.S. HOUSE OF REPRESENTATIVES
Retirements, new arrivals and new assignments have resulted in significant changes in FRCA’s key House Committee.

House Transportation & Infrastructure Committee
Perhaps the most notable change will be on the House Transportation & Infrastructure (T&I) Committee, which like the Senate Commerce Committee, will continue its oversight of the implementation of the STB Reauthorization Act of 2015, the railroad industry’s continued implementation of positive train control technology, and the activities of the FRA.

The Committee’s leadership remains unchanged, with Rep. Bill Shuster (R-PA) serving as chairman and Rep. Peter DeFazio (D-OR), returning as ranking member.

Six Committee members from the 114th Congress did not return in January.  Rep. Ann Kirkpatrick (D-AZ-1), ran unsuccessfully for the U.S. Senate against incumbent Sen. McCain.  Rep. John Mica (R-FL-7) unexpectedly was defeated in his reelection bid, while Rep. Janice Hahn (D-CA-44) ran a successful campaign for the Los Angeles County Board of Supervisors.   Rep. Corrine Brown (D-FL-5) was defeated in a September primary election and Reps. Richard Hanna (R-NY-22) and Candice Miller (R-MI-10) retired.

The Committee has 14 new members this year, Representatives: Randy Weber (R-TX-14); Doug LaMalfa (R-CA-1); Bruce Westerman (R-AR-4); Lloyd Smucker (R-PA-16); Paul Mitchell (R-MI-10); John Faso (R-NY-19); Drew Ferguson (R-GA-3); Brian Mast (R-FL-18); Jason Lewis (R-MN-2); Frederica S. Wilson (D-FL-24); Donald M. Payne, Jr. (D-NJ-10); Alan S. Lowenthal (D-CA-47); Brenda L. Lawrence (D-MI-14); and, Mark DeSaulnier (D-CA-11).

Railroads, Pipelines and Hazardous Materials Subcommittee
Cong. Jeff Denham (R-CA-10) returns as subcommittee chairman, while Rep. Mike Capuano (D-MA-7) returns as ranking member.

New members of the Subcommittee are Congressmen: Mark Meadows (R-NC-11); Mark Sanford (R-SC-1); Randy Weber (R-TX-14); Bruce Westerman (R-AR-4); Lloyd Smucker (R-PA-16); Paul Mitchell (R-MI-10); Mark DeSaulnier (D-CA-11); Jason, Lewis (R-MN-2); John Faso (R-NY-19); Don Payne (D-NJ-10); John Garamendi (D-CA-3); and, Andrew Carson (D-IN-7).

House Appropriations Committee
As with its Senate counterpart, the House Appropriations Committee is responsible for providing the annual appropriated monies for the STB and FRA.

Rep. Rodney Frelinghuysen (R-NJ-11) assumed the chairmanship of the full Committee because the previous chairman, Rep. Hal Rodgers (R-KY-5), had served three terms in that top slot.  Rep. Nita Lowey (D-NY-17), returns as ranking member.

Three members of the House Appropriations Committee retired at the end of the 114th Congress: Representatives: Steve Israel (D-NY-3); Ander Crenshaw (R-FL-4); and, Reid Ribble (R-WI-8).

New members named to the Committee for the 115th Congress are Congressmen: John Moolenaar (R-MI-4); Dan Newhouse (R-WA-4); Scott Taylor (R-VA-2); Grace Meng (D-NY-6); Mark Pocan (D-WI-2); Katherine Clark (D-MA5-); and, Peter Aguilar (D-CA-31).

Transportation Subcommittee
On the Transportation, Housing and Urban Development and Related Agencies Subcommittee, Rep. Mario Diaz-Balart (R-FL-25) returns as chairman, and Rep. David Price (D-NC-4) continues as ranking member.
Leaving the subcommittee are Representatives:  Kevin Yoder (R-KS-3); Evan Jenkins (R-WV-3); David Jolly (R-FL-13); Tim Ryan (D-OH-13); and, Henry Cuellar (D-TX-28).

New members of the subcommittee include Congressmen: David Valadao (R-CA-21) Tom Graves (R-GA-14); Charlie Dent (R-PA-15); Katherine Clark (D-MA-5); and, Pete Aguilar (D-CA-31).

House Judiciary Committee
As noted in the Senate discussion, railroad anti-trust issues rests with the House T&I Committee but the activities and perspectives of the House Judiciary Committee are relevant to FRCA and all freight rail shipper concerns.

Carrying over from last Congress, Rep. Bob Goodlatte (R-VA-6) is Chairman while Rep. John Conyers (D-MI-13) is Ranking Member.

On this Committee, Congressman Randy Forbes (R-VA-4) was defeated in his primary race.  Other members not serving are Representatives:  Dave Trott (R-MI-11), Mike Bishop (R-MI-8); and, Scott Harvey Peters (C-CA-52).

New Committee members include Representatives: Martha Roby (R-AL-2); Matt Gaetz (R- FL-1); Mike Johnson (R-LA-4); Andy Biggs (R-AZ-5); Eric Swalwell (D-CA-15); Ted Lieu (D-CA-33); Jamie Raskin (D-MD-8); Pramila Jayapal (D-WA-7); and, Bradley Schneider (D-IL-10).

House Agriculture Committee
As with the Senate-side, the House Agriculture Committee is of importance to FRCA and freight rail shippers.

Returning as chairman is Cong. Mike Conaway (R-TX-11) and Rep. Collin Peterson (DFL-MN-7) as ranking member.

Five members of the Committee retired in December 2016, Representatives:  Ann Kirkpatrick (D-AZ-1); Gwen Graham (D-FL-2); Dan Benishek (R-MI-1); Chris Gibson (R-NY-19); and, Randy Neugebauer (R-TX-19).  Other members not serving this new 115th Congress are Congressmen:  John Moolenaar (R-MI); Dan Newhouse (R-WA); Pete Aguilar (D-CA); Gwen Graham (D-FL); and, Brad Ashford (D-NE).

There are 12 new members on the 45-member Committee.
